A contract employee transferred from one organization to another organization during maternity leave. The employee is covered under ESI. When the employee delivered a child, she was with the new employer. Both organizations were under the same principal employer.

Technically, is she eligible for ESI benefits under the new employer?

Yes, CL is eligible for ESI benefits from the current employer. Also, transfer the old ESI contributions to the current employer.

As per the rules, any woman shall not be allowed into the factory while she is pregnant. However, if allowed, it's a sensitive issue to be handled according to the situation.

yes she can avail M benefit under ESIC , but only if she continued with the previous IP no i mean previous esic No , she can transfer her previous contribution to avail full benefit .

Yes, she will have to be covered; if not, the Principal Employer will become liable. From the employee's point of view, she needs coverage under all statutes, i.e., the law, from whom is not her problem.

HI She is eligible to get the M.B. under ESI Act, only thing she has to convince the ESI Authorities about her past contributory service with other employer, regards Hiren Chheda Mumbai
