With the reference to the cited subject, i work in a private limited company and initially we made the policy of Earned Leave encashment up to 50 Leaves and thereafter we will encashed the leaves, i would like to know is there any standard policy for providing maximum ELs to the employees.

    First decide which of the Act is applicable on your company i.e. Factories Act, 1948, State Shops & Establishment Act, Mines Act, Plantation Act etc. & thereafter go through the applicable EL provision in that Act for grant, accumulation of earned leaves & en-cashment of EL. You are not allowed to encash EL during service period up to the maximum no. of ELs allowed to be accumulated under the provisions of the applicable Act. Leave policy framed by the company should not be contrary to the enactment applicable to the company. Framing of Leave policy is required when you are interested in granting better facility against as provided by the applicable Law, If your unit is covered under Factories Act then you should go through chapter VIII on leave with wages.
