Hi Everyone,

I am working at ABC company. However, after completing 8-9 months, they gave me a poor performance review. During an HR call, they mentioned that they would assess my situation over the next 15 days. For job security, I have started looking for other opportunities and have received an offer letter from XYZ company, requiring me to join within 15 days. Upon resigning from ABC company, they informed me that, as per policy, I must serve a 90-day notice period or have the option to buy out the notice.

Consequently, I decided to work for both companies. After two months, XYZ company requested a release letter. I modified the offer letter and submitted it to them.

Recently, I received an email from ABC company stating that I provided falsified documentation and inaccurate information. They are withholding my last two months' salary and demanding one month's salary. While I possess a few PL (Paid Leave) days in my account, they stated that they do not offer encashment or settlements for the same.

I seek your advice on what steps to take next. Thank you in advance.

Though it can be contested on the point of refusal of encashment/adjusting the PL, looking at the facts and circumstances narrated in your query, it seems better to settle the issue without creating much ado. Yet, I would suggest you follow up with ABC Company for whatever concession you can wrangle out of them.
