In our company, one of our employees went to the USA on an H1-B visa to work for our parent company. He didn't resign here; instead, he got transferred from the company here in India to the parent company in the USA. Is providing a relieving letter mandatory for him/her? Or if we want to provide a relieving letter and an experience letter together, how can we do it without mentioning resignation in that? If anyone has a sample letter, kindly help me with that.

You can issue an experience certificate as below. You may edit as per your requirement.

This is to certify that Mr. ________ worked with us as _____ in our organization from _______ to _______. He is in receipt of a CTC salary of Rs. ______ per month.

During his tenure with us, we found him sincere, honest, hardworking, and a dedicated employee with very good job knowledge.

Due to exigencies of business requirements, he is transferred to our Parent Company _________ (name of the Company and location) by the closing hours of _____.

We wish him all the success in his new assignment.

A mere Service Certificate will only be viewed as a support. Recently, a company was ordered to pay gratuity on the last drawn wages at the Euro/$ converted to Indian currency and also for services rendered there. The order of the Controlling Authority was confirmed by the Appellate Authority. Now we have to wait for the High Court verdict.

So it would be better to issue him a Relieving letter and settle his PF accumulation.
