Hi All, I am working XXX BPO. Due to covid company made policy for Work From Home, that nobody can move to home town or other places without informing. I went to a wedding to my home town without informing the company as my leaves got rejected, but I login online from my home town.

Now, the company has revoked my increment which was done in April 2021 as a disciplinary measure.

Can you tell me is it legal on the company's behalf to revoke my increased salary and putting me back on last year's salary?

A private management company can very well hold disciplinary proceedings against its employee and can enforce punitive measures, if required. But in public limited company there are procedures;

As I presume, you are working in a private management company, your management is fully emplowered to take any disciplinary action against you for "wilful disobedience" and that you are not supposed to challenge it.

As you are aware that your management had promulgated an HR policy that no employee can visit their home town/other places without intimation, why did you turn down such instructions? And proceeded to your hometown wiithout informing your company. Your this act, was viewed by management seriously.

Without prejudice to the right of the Management to take disciplinary action against the poster and notwithstanding the poster is a workman or otherwise, the action of the Management revoking the increment already sanctioned gives rise to the question of proportionality of the punishment to the misconduct alleged. The poster did not mention whether the punishment was awarded straight away or after giving him a chance to explain his stand.

Employer can take disciplinary action against you since you didn’t followed the laid down norms/guidelines. However you still have the right to appeal as per your company’s policy.
