If the company has 23 calendar days of leave (including Saturdays and Sundays as weekly offs, Christmas on the 25th, and New Year's Day on the 1st of January):

1) In the scenario mentioned above, if an employee applies for 23 consecutive days of leave starting from the 2nd of December 2019, when can he resume office - on the 24th of December or the 6th of January 2020?

2) If he takes leave from the 2nd of December 2019 and returns to the office on the 9th of December, how many total leave days should be deducted - 5 or 7 days?

3) Please inform me if there is any specific calendar leave policy in India.

Dear Akshadevi, it would be fair to answer your query only after knowing the leave policy of your firm. Subject to this, I would give my first impression.

1) 23 days leave effective from 2.12.2019 (includes 2nd), therefore he has to resume duty on the 24th, which is a working day. Then he can avail paid holiday on the 25th (Christmas).

2) If he avails leave from 2.12.19, he'll be on leave till the 6th, availing the 7th & 8th as weekly off and then resume on Monday. Hence, debit 5 days only.

3) If your firm is located in Mumbai, you have to follow the leave list published by the Government of Maharashtra. This should be concurrently applied with your leave policy.
