Issue with PF Arrears and Challans

I have a security agency where I supply guards to PSUs. Sometimes, the rate of basic salary is increased with retrospective effect. In such cases, the arrears of PF are deposited in the month when the salary increase is implemented and paid out.

I paid the PF due on the arrears, and despite the fact that the ECR was filed for arrears, the EPF site has generated 7Q-14B challans for delayed payment of PF dues. How do I get this challan canceled?

In an earlier instance, I paid up in good faith and wrote to the EPF office to adjust the same against my account but have not received a reply. It has been 6 months now.

Please advise how I should proceed further now.

It's unfortunate that you're facing such issues with the EPF site. Here's what you can do:

1. 📝 Write a Letter: Draft a formal complaint letter to the Regional PF Commissioner of your jurisdiction. In this letter, narrate your issue clearly and request for the cancellation of the 7q-14B challan. Mention that the due payment was made in good faith and that the ECR was filled for arrears.

2. 📚 Include Supporting Documents: Attach photocopies of relevant documents to support your claim, such as the ECR, the challan you received, and proof of your payment.

3. 🚚 Send the Letter: Send this letter via registered post or speed post to ensure you have a record of it being delivered.

4. 🖥️ Online Complaint: You can also lodge a grievance online on the EPFO grievance management portal 'EPFiGMS' (https://epfigms.gov.in/). Click on 'Register Grievance', fill out all the necessary details and describe your issue in the 'Grievance Description' box. Upload supporting documents if necessary.

5. 📞 Follow Up: Keep following up with the regional office regularly. You can call or email them to check the status of your complaint.

6. 🤝 Seek Professional Help: If you're still not getting a response, consider seeking the help of a professional consultant or lawyer who specializes in such matters.

7. 🏛️ Legal Action: If the issue persists and the EPF office doesn't respond, you may need to approach the Employee Provident Fund Appellate Tribunal.

Remember, it's important to keep all your communications and documents organized and readily available. These will be helpful in supporting your case if the need arises.

Please note that each case is unique and the steps mentioned above are general advice based on the information provided. It would be best to consult with a legal professional for advice tailored to your specific situation.
