Dear All,

Recently, an employee has come to me stating that the ESI dispensary requires an affidavit confirming that her husband is dependent on her and his earnings are Rs. 5000/- or less per month. They have not addressed her case. If this is true, I find it absurd. I would appreciate it if someone could clarify the correct position on this issue.

In the case of a spouse, there is no need to give an affidavit or declaration that his/her monthly income is not more than Rs 5000. This declaration (online declaration is sufficient) is required only for dependents like father, mother, or siblings who have no parents and are fully dependent on the income of the IP.
