A workman has been transferred from his place to another state after 18 years of service. The workman has challenged his transfer as malafide through the labor tribunal. Now, employers have neither terminated nor suspended this workman and stopped his salary from the month of the transfer. How to overcome this situation to get his salary/reinstatement.

From an employer's point of view, the employer is absent as the transfer has been initiated, and the employee has not reported to the workplace. SCN for being absent 3 times, on the notice board also, and thereafter "no trace," strike off the name from the payroll.

From an employee's point of view, let the labor tribunal decide.

Does the appoint order has transfer clause? and if so, the employee can not say no. As rightly indicated by Mr Sharma follow the same. Srinivasan
