First of all, you need to be "professional and polite" while posting something. If the employer is deducting some amount from the employee's salary, it is compulsory that the employer has to fulfill their role. Do not worry. 1. Deducting the employer's share of contribution also from the wages of employees is an offense punishable under Para 76(a) of the EPF Scheme, 1952. Some of the prosecution provisions are also mentioned under Section 14 of the EPF & MP Act, 1952. Therefore, in my opinion, the aggrieved employee has to take up the matter with the authorized officer of the EPFO to which his unit/employer is attached/covered.
2. The Labour Department of the State, in my opinion, has no role to play in the matter. Even otherwise, the compliance with statutory provisions of the various State Government-enforced labor laws is very poor.
