I met an accident while going to the office in January 2010, and I am covered under ESIC. At that time, ESIC gave me about 3 months' salary as a benefit but refused to give Permanent Disablement Benefit (PDB) as commuting accidents were not covered. However, I have now heard that as per the amended provisions of the Act w.e.f. 1/6/2010 of ESIC, these commuting accidents are covered.
Eligibility for Permanent Disablement Benefit (PDB)
So, my question is, am I eligible for Permanent Disablement Benefit (PDB) as I had an amputation below the knee and have a permanent disability of 70%? If not, can I file a case against ESIC in court? Please help me as soon as possible.

The amendment to the Act has no retrospective effect and therefore, it is difficult for you to get the status of Permanently Disabled. Madhu.T.K

Hi everyone and seniors, I have a query regarding Permanent Disablement Benefit. In my unit, one workman met with an accident in 2011, and he lost one finger in the accident. He has been paid wages for 3 months from ESIC, but he has not received the PD benefit yet. In my position, there was another person who had not focused on this issue and had not recorded it in the accident register. Now, the workman is asking me about this benefit. What should I do in this issue? Are there still any chances for applying again for the PD benefit? If so, what is the procedure for that? I am a specialist in EPF provisions but do not have much experience in ESIC procedures. Please help me out in this matter.
