Eligibility of Contractual Employees for Probation Period

Are contractual employees eligible for a probation period? If yes, can we terminate the contract during the probation period? We are looking to hire contractual employees and want to avoid any legal complications that may arise due to any flaws in this process.

A contractual employee cannot logically be on probation because they are already committed to ending their services after the contractual period. You can terminate the contractual employee at any time by referring to the terms and conditions of their employment with you.

Understanding Probation and Contractual Employment

The very first thing to note is that probation and job on contract are two different things. Probation is a kind of testing and examination of work performance, whereas a contract is a fixed period of employment for a certain duration.
