If attendance register is compulsory in all offices, please let me know under what act and section it falls.
I work in a construction/architectural firm where senior and junior staff work. The remuneration is good. One employee with 10 years of experience declined to sign the attendance register. What should I do? I informed management, but the issue persists. We also have an electronic system, but it is not up to standard.
If it falls under the Wages Act 1936, specifically under section 6, it applies to workers and not to higher-ups when the gross remuneration is too high.
Please advise on how to handle this situation.

Electronic Record Maintenance Under Labor Laws

It is also prescribed under the provisions of the Factories Act and the Shops and Establishment Act. If you have permission to maintain the records in soft copy, you may continue with the electronic system. Permission should be obtained from the Labor officer.

Hi Sekhar,

Maintenance of the attendance register is quite mandatory, whether using a manual register or a system-operated one is optional. Regardless of the pay and designation, every employee is supposed to sign or swipe their access cards to maintain their attendance record and manage leave.

Therefore, please take a printout of "Please sign/swipe your cards during entry and exit to maintain a concrete record - Team HR" and post it at all entrance and exit points on every floor/level.

Furthermore, send a circular to all junior and senior staff members stating that the HR and Admin departments are experiencing difficulties during payroll processing. Hence, everyone must sign/swipe for accurate payroll results.

If you want to do away with maintaining manual registers, you have to take permission (exemption) from the Dy. Labor Commissioner of your area.

Dear Shekhars,

I believe you should follow Srividya's instructions and then consider the electronic attendance along with the register when processing payroll for one or two months. After that, you can regularly choose one reference to fix.

If a person has not signed the register or has not swiped the card, you should consider them absent.

Please share your views on this, all of you.

Dear All,

This is a general circular stating that henceforth, attendance will only be considered from the Register/Swiping Machine. Employees who forget to sign or swipe their cards must notify HR with necessary approvals/reasons for consideration. The email should be sent before the end of the day, otherwise, it will not be considered. A non-swiping or unsigned day will be marked as Absent.

After this circular, you may proceed with the payroll based on your attendance register. It is advisable to update your attendance records. This will help you address management queries when deducting the salary of an individual.

Dear Ramanuj, Let me know under what act and section which it comes. If the gross pay ranges from 50 k and above will the act will be same. kindly help.
