Sir,
My son has joined a central government department under the sports quota and has signed a service bond for five years at the time of joining. After serving for four and a half years, he had to resign from the job as he received a better offer from a PSU. He has submitted a proper resignation letter with a copy of the new appointment letter attached. Now, after a gap of five years, he has received a letter addressed to the present employer asking my son to pay a hefty amount for not fulfilling the bond period.
Please advise me urgently whether there is any time limit (three years) for enforcing the bond agreement. They have not spent any amount on my training regarding official or sports activities.
Thank you.

Dear Mr. Janarthanan,
In general, service bonds are not valid in India. Please find the attachment. However, please do consult Legal Advisors - Labour Related and verify if your Service Bond has any specific clauses. It is better to seek clarity from experts.

Without seeing the bond, it is not possible to comment. However, if the bond is one-sided, generally, it is not valid. Was there a mention in the offer of appointment that he has to submit a bond for five years? If not, then it is not valid.
At the time of resignation, if it was accepted without mention of the bond, it is illegal to ask now. Please give me a brief history of events; only then can you be advised.
