I have seen many advertisements where the principal employer asks for labor licenses before issuing a work order or tender. My confusion lies in the scenario where the principal employer has not issued Form No. (V); how is it possible for a contractor to obtain the same licenses? Are there any other licenses available? Please clarify.

As far as in know contractor has to get his licence done when he is engaging 20 or more worker for the work against workorder....

You are correct. No contractor can get a labor license without registration under the Shops and Establishments Act. However, he can register under the Shops and Establishments Act and obtain the codes for ESI and PF.

Without the registration of the Principal Employer and without him issuing Form V to the person engaged as a contractor, a license cannot be issued to a contractor. Please note that in Form IV (application for a license), the number and date of the Certificate of Registration of the establishment under the Act have to be mentioned in column 3(c). A license under the Contract Labour Act does not depend on the registration under the Shops Act, ESI Act, PF Act, etc.
