As per the PF Act the principal employer is liable to pay his share of contribution upto Rs.6500/- basic+ DA. He need not pay for above Rs6500/-. This doest mean that he will not pay atall.
He have remit his contribution of Rs.6500/- ie Rs.780/-

Hi,
Dear sivasuil,
1. you check, more than 20 employees are working in his company.
2. If yes, you ask registration certificate.
3. Even if he shows Basic+DA as 6500, he has to deduct 780/- i.e. ceiling.

Hello Everyone .
Sub: Regarding P.F. ceilling
If employee basic+d.a is more than 6500 than maximum Ded. from employee End is 780.00 & it is depends upon employee he /she want P.F .deduction or not But It is comulsory form -11 filled by emplyee volutarily & submitted in the concern P.F. department.
Condition : Employee New Joined & basic+d.a. is more than 6500.00
Employee should not have been a member of PF any time during his previous employement
2. Employee should have withdrawn all his previous PF accumulation if any.

If contractor employees Basic+DA more than Rs.6,500/- need not pay PF, but please check their salary register and Salary lessthan 15,000 /- they should pay ESI. K Subramanian

Dear siva ,
As per PF act Wages Means Basic+Da So compulsary deduct and pay the PF for Basic+Da(ie: Basic-3500+Da - 3000 total pf Rs 780+780=1560/-)as per EPS Act sealling for wages Rs 6500/- above that wages need not to pay.Only follow the up to sealing wages.

The cardinal principle is that, an employee( otherwise fulfilling the criteria of >20 persons engaged) whether by the Principal Employer or the Immediate Employer( Contractor), enters first time in employment and draws a basic salary( not + D.A) > 6500/- per month then he can apply for exemption from P.F to be declared as an exempted employee. Other than this all are to be covered under P.F. Act, up to Basic Pay<= Rs. 6500/-
Even if the contractor disobeys this, the Principal Employer is supposed to pay the P.F. contribution on behalf of the contractor and adjust the amount from his bill.

There is no rule for compulsory pay of P.F if salary goes above 6500/-basic+D.A
It can be possible with mutual understanding of contractor and contract worker in written.you can also demand for P.T challan .

Dear Shiva,
Payment of PF is must by Contractor, whether the salary is morethan 6500/- or not, this 6500/- clause is applicable particularly to have a Sealing in PF.
Whether the employees basic + da salary is morethan 6500/- then upto 6500/- only you can recover PF amount any pay.
If any management wanted to pay on the Total Basic + DA amount is applicable also.
So you should insist Contractor to Pay PF also.

hii,
my que is if any establishment has PF no. but some of his employee drawing wages basic+DA more than 6500, in this case we have to fill form 11, but some says that subimt this form 11 in pf department some says not compulsory, just maintain form 11 in your company PF record?????
