In the offer email, my employer had mentioned that they were ready to buy back my notice period salary but would recover the same if I resigned within one year. However, there has been no mention in my appointment letter (hard copy receipt of which has been acknowledged by me). Now, since I have resigned from the company, does the company have the right to recover the amount? In my opinion, they cannot as the offer letter does not have a legal binding on both parties. Please let me know the correct stand. Also, if I need to take up the matter legally, please let me know whom to approach.

If notice period clause is not mentioned in you offer letter or appointment letter. Then according to me they can not ask for notice recovery. Kapil Kotwal

Same thing happen with also, but there were no clause in offer letter nor in appointment letter. Does company have the rights to recover that amount and if not then what should i do.
