Hi, I worked in the development sector. Currently, I work in the private sector in another state where the PF system is not applicable. I went to the PF office here to claim my PF, but they suggested I claim at my previous place of employment. When I went there, they gave me a lot of excuses, and there has been no clearance of my PF settlement for 2 years. Now, I am thinking of searching for a new organization where PF is applicable so that I can transfer my PF account with the support of the PF office.

I want to know if the new organization can transfer my PF account with the help of the PF office or if they need to follow a procedure with my previous organization or the PF office. Please help me, what can I do... :(

Your previous organization has to send the details of your employment and PF deductions to the PF office in a prescribed format, for which you have to fill a prescribed form of application. If your new organization has no PF facility, the PF office, based on your previous organization's report (prescribed proforma), will return your money to the account number. You have to provide your account number, etc., in the prescribed proforma application.

There is something wrong with your previous employer. Please pursue it carefully, and if they don't cooperate, just file a complaint with the PF office.

If you have spoken to your previous employer and he is not replying satisfactorily, then you should withdraw that amount by filling out Form 19 and 10C and deposit it directly to the PF office. Include a letter stating that your previous employer is not cooperating and not signing my PF form.

Hello Mr. Malik,

I would like to know whether the consultants deployed in the organization are eligible for PF. If we deduct their amount for a certain month without their knowledge, is it claimable or non-claimable? Please do reply to me.

Dear,

Basically, consultants are not employees of the organization and they should be treated as professionals. No PF should be deducted on their behalf. If you have deducted by mistake, then adjust it during the annual return.

You had mentioned earlier that if my previous organization does not cooperate with me, then I can submit the form with a letter stating so. But will it be granted? Will the PF authorities take the responsibility of disbursement of my PF money and enquire with the company?
