Dear Friends,

The government of India made certain fundamental changes via a notification dated 1 October 2008 in the Employee Provident Fund Scheme, 1952, and the Employee Pension Scheme, 1995 (collectively referred to as Indian social security schemes). This has a significant impact on expatriates and the employers with whom they work in India.

The Additional Central Provident Fund Commissioner (ACPFC) issued certain clarifications regarding these amendments in his letter dated 7 January 2009 (No. Actuarial/7(9) 2008/ 75683) to all Regional Provident Fund Commissioners. Additionally, the Ministry of Labour has posted some FAQs on their website (www.epfindia.com) clarifying the position concerning the International Worker (IW). For ready reference, I am attaching the Word file.

Hi Everybody,

I require some help to clarify certain queries on "PF Deduction on International Worker."

1. Whether the Pension amount (8.33%) will be given to IW despite withdrawing within 6 months? Many people hardly stay for 3-4 months.

2. Do we have to allot a new PF A/c No for each visit if the IW comes 2-3 times in a year?

3. Will the withdrawal amount get transferred to their abroad account?

4. Does the NSSN form need to be filled?

5. Can Form 11 be an option for them?

6. How will they get their PF slips?

7. What will be the scenario in the case of the death of an IW?

8. Will the EDLI deduction provide the same benefit in an accidental death case? Which form needs to be filled?

9. Is there any Loan/Advance facility available?

Hi Everybody,

My ex-employer, M/s. Mars Restaurants Pvt. Ltd., has not given me my full and final settlement dues. It has now been a full year since I left, and they are still avoiding me and not responding to my emails. Please advise on what steps I can take.
