Dear Friends,

A new PF Form No. 5 has been introduced for the coverage of Provident Fund for international workers in India. Please see the attachment. This may be very useful for MNC companies working on projects.

Thank you for the information.

I have a question on exactly who will qualify as an international worker.

1. Example: I have an employee who has been working in the US for the last 10-12 years and has US citizenship. This employee has permanently relocated to India since Nov 08. Will he be considered an international worker?

2. Example: I have an employee who has been sent on a long-term assignment to a different country, and the payment conditions are as follows: he receives his regular salary in India and also receives a salary in the other country. Will this employee be classified as an international worker?

Thank you.

Dear All,

In our company, overseas employees are working on a temporary basis, deputed from the parent company in China. They are providing services and receiving salaries from China. These employees hold business and work permit visas.

The question arises whether they will fall under the international worker PF scheme or not. If they are covered by the international PF scheme, how should we apply for a PF number, process individual accounts for them, and settle the PF of resigned employees?

Thank you.

As per revised PF norms for international work, there is no time limit. Any assignment if they are on work permit visa, the pf is to be deducted from the date of joining

International Workers and PF Remittance Process

Please advise:

• International workers regarding the PF remittance process and its applicability.

• How to submit the PF remittance process.

• If a person from another country works only three months in India (project site), is it applicable for PF remittance? Yes or no. If yes, how to submit the PF returns and state that English will be used to claim the EPF amount process.
