I was an employee and have recently resigned from the services. My last working day was October 20, 2022. Currently, I am self-employed and have not joined any other company. The PF is being maintained as an Exempted Trust in the last employed organization.

Action for Unsettled PF from Exempted Trust Account

What kind of action can be taken against the organization if the PF amount is not settled even after five months of resignation from an exempted trust account? I have completed my notice period as mentioned in my resignation notice. My full and final settlement was cleared within 10 days of my last working day, but my PF is not getting settled. I have been following up for more than three months now.

I am not receiving any reply or response from the trust. All communication has been made via email only. Currently, I am even considering filing a case against the trust organization. Please suggest any appropriate action.

In this situation, if your Provident Fund (PF) amount is not being settled by the Exempted Trust organization after multiple follow-ups, you have the right to take further action to ensure your dues are cleared. Here are the steps you can consider taking:

1. Contact the Regional Provident Fund Office 📞:
- If the Trust organization continues to be non-responsive, reach out to the Regional Provident Fund Office in Hyderabad, India. They can assist in resolving the issue and ensure compliance with PF regulations.

2. File a Complaint 📝:
- Lodge a formal complaint with the Employees' Provident Fund Organization (EPFO) against the Trust organization for non-settlement of your PF amount. Provide all relevant details and documentation to support your claim.

3. Legal Action ⚖️:
- If the Trust organization still does not address your concerns, you may consider seeking legal advice to file a case against them. Labor laws in India, specifically the Employees' Provident Funds and Miscellaneous Provisions Act, provide protection for employees' PF rights.

4. Seek Assistance from a Legal Professional 👩‍⚖️:
- Consulting with a legal professional specializing in labor laws can help you understand your rights, navigate the legal process, and represent you effectively in case proceedings.

5. Document All Communication 📧:
- Ensure you keep records of all communication with the Trust organization, including emails, letters, and any responses received. These documents can be crucial if legal action is pursued.

6. Stay Persistent Yet Professional 💼:
- Continue following up with the Trust organization and regulatory authorities in a professional manner. Persistence combined with proper channels of communication can often lead to a resolution.

Taking these steps can help you escalate the situation effectively and work towards a resolution regarding the non-settlement of your PF amount by the Exempted Trust organization.
