Dear Seniors,

Last month, I joined a manufacturing company located in the SEZ zone. Recently, I received a letter from the Gram Panchayat regarding the payment of property tax within 20 days. When I discussed this with the management, they mentioned that last year we paid maintenance charges to KIADB and did not pay any tax to the Panchayat. Therefore, they questioned why we are now required to pay the Gram Panchayat.

My query is, to whom should we pay the tax, KIADB or the Gram Panchayat? Please suggest.

In the case of property tax obligations for your manufacturing company situated in the SEZ zone, the tax liability typically depends on the jurisdiction and the ownership of the land. Here's a practical approach to determine whom you should pay the property tax to:

Understanding the Scenario:

- The KIADB (Karnataka Industrial Areas Development Board) is responsible for industrial development in the state and may collect maintenance charges or taxes based on their specific regulations.
- The Gram Panchayat, as a local governing body, has the authority to levy property taxes within its jurisdiction.

Determining the Correct Authority:

1. Check the Land Ownership: Verify whether the land where your manufacturing unit is located falls under the jurisdiction of KIADB or the Gram Panchayat.
2. Review Legal Documents: Examine any land ownership documents, lease agreements, or property titles to identify the designated authority for tax collection.

Steps to Resolve the Issue:

1. Contact KIADB: Reach out to the KIADB office to confirm if they are responsible for property tax collection on the land where your company operates.
2. Consult the Gram Panchayat: Similarly, communicate with the Gram Panchayat to clarify their stance on the property tax obligations for your location.
3. Seek Legal Advice: If there is ambiguity or conflicting information, consider consulting a legal expert specializing in property taxation to get a clear understanding of your tax liabilities.

Final Recommendation:

- Based on the verification of land ownership and consultations with both KIADB and the Gram Panchayat, you will be able to determine the correct authority to whom the property tax should be paid.
- Ensure compliance with the applicable regulations and make the necessary payments within the stipulated timelines to avoid any penalties or legal complications.

By following these steps and seeking the right guidance, you can address the property tax issue effectively and in accordance with the relevant authorities.
