Hi, I have a situation with my notice period. I have been working as a process associate for the past 1 year and 6 months, and I received an offer from Amazon to join immediately. They gave me a joining time of 10 days, which I accepted after speaking with my team lead. However, my current company is not willing to reduce my notice period even though I am willing to pay out. Even HR is ready for that, but my operations team manager is insisting on a one-month notice period. I am unsure of what to do. He is not open to negotiation and is not accepting my request. Additionally, the new company I wish to join is not open to taking me later. I am concerned about the impact on my career. Please help me navigate this situation. What steps can I take to address this issue effectively?

Please do not commit to any dates with a future prospective employer without getting confirmation from your current employer. Mere confirmation from the Team Lead will not be sufficient. HR and your final superior should also accept it. All companies will provide a pay in lieu of notice period option but normally will add a line "at the discretion of the employer," so it depends on your nature of work and whether a replacement is identified, etc.

The only thing you can do is request politely with your Operations Team Manager and ask for their help.

Alternatively, you can quit without information, wherein your 1.6 years of experience will become meaningless. You will not receive an experience certificate/settlement, and it will have an impact on your future employment.

You can also talk to the HR of Amazon and explain your situation, that you need to complete your duties with your current employer. Make it more professional and present yourself as very duty-conscious.

I already tried speaking with Amazon HR, and she said she will cancel the offer if I cannot join on the 14th. My operations manager from the previous company knows about this, but he is deliberately not letting me go for the new company even though the onboarding is completed. I have tried everything possible with the operations manager, but he doesn't want to help me, even though there are no responsibilities for me.

Hi, understood. I'm not sure whether your new employer will accommodate you without a relieving letter from your last employer. Also, your current employer can sue you for dual employment if you claim that your Operations Manager knows you are joining Amazon.

I am already on my notice period. I will be writing a last working day email and submitting my assets on the 11th, even if the operations manager does not agree. I am going to surrender all the assets. This is what my team lead told me to do if they don't let me go.

Hi, please check with Amazon if they can buy out your notice period from your current company. You can also check with your current employer if you can pay for the notice period in lieu of serving it, which means forgoing all the final settlements and paying the difference amount to get relieved. If you are not in a critical project and they still want you to serve the notice period, consider approaching the local labor court since they cannot bind you to the notice period if you have agreed to pay for it instead of serving.
