Hello Everyone, An employee is under a two-year contract (signed on letterhead) and wishes to resign in the middle of the period. Due to an emergency, he received his service bonus in the 12th month of his service, but he won't actually receive it until the 18th month. He is now requesting a letter of relieving and experience, as well as his current month's salary. According to his statement, he will serve a three-month notice period as a permanent employee. We need input from everyone on this.

A service bond is valid only if you have provided specific training, and the cost of the training is recoverable if the person leaves before the expiry of the period. It does not actually stop the employee from leaving but gives the company the right to recover the specified training cost.

Implications of Refusing Resignation
However, most companies will refuse to accept the resignation and will not provide the salary or relieving/experience letter. Having an employee who knows you are going to refuse to cooperate is not someone who should be working for another 3 months in your organization, as he can (and probably will) create a problem for you.
