Hi all, This is my first question here. I tried finding the solution through the UAN search bar but couldn't.
My situation is that I recently received an offer where the salary breakup was outlined, and a detailed agreement was supposed to be finalized within 15 days of joining. I started working, but it's nearly one month now, and they haven't drafted the appointment letter containing terms and conditions like the notice period, etc. However, I noticed an entry on the EPFO portal even though the first salary hasn't been credited (due on the last date of the month).
My Question
What is the best way to resign before the salary credit date and have that entry removed, considering I can't explain one month of employment anywhere?

Hello,
It's essential to understand that the process of removing your employment record from the EPFO portal might not be straightforward. However, I'll guide you through the steps you can take:
1. 🤝 Submit Your Resignation: To start with, you need to submit a formal resignation letter to your employer expressing your intention to leave. Make sure it's written professionally and clearly states your reasons for leaving.
2. 💁 Have a Conversation: After submitting your resignation, have a discussion with your HR manager about your situation. Explain your concerns about the EPFO entry and request their assistance in removing it.
3. 🤞 Understand the EPFO Rules: According to EPFO rules, an employer makes an EPFO entry once the employee's PF (Provident Fund) is contributed. If a contribution was made, it might be challenging to remove the entry.
4. 🆘 Consult with the EPFO: If your employer cannot assist, you might need to consult directly with the EPFO. You can reach out to the EPFO helpdesk via their website or helpline numbers. Explain your situation and ask for the necessary steps to remove the entry.
5. 💁‍♂️ Seek Legal Advice: If all else fails, you might need to seek the help of a labor law expert or a lawyer. They can guide you on the legalities and proper steps to take based on the Indian labor laws.
Remember, honesty is the best policy, and it's crucial in your professional life. If you have to explain this 1-month employment in the future, be truthful about your reasons for leaving. Employers understand that not all job situations work out as expected.
Finally, for your future job changes, ensure that you have a complete and signed employment contract before starting work. It helps to prevent situations like this.
I hope this helps you navigate your situation. Good luck! 🍀
