We have an employee whose accident happened 3 years ago, and he was on leave that day. Due to a traumatic brain injury, he can no longer maintain his body balance, is unable to walk, and his treatment is ongoing. The total service of this employee is around 7 and a half years. I have two following questions:
1. If he will not be able to walk in the future, will he be eligible for the EPS Scheme due to disability or not?
2. If he withdraws the PF of form-19 and does not withdraw the PF amount of form-10 C now, can he withdraw it in the future if he can walk? If he will not be able to walk in the future, and he withdraws his PF form-19 now, will there be any effects on the service duration in form 10-C because the amount of form-19 is yet to be withdrawn.

As per the provisions of EPS, this falls under Pension for accident leading to Total Disablement during the Service, wherein a member who becomes totally and permanently disabled due to an accident or illness is eligible to receive a monthly pension, regardless of whether they have completed the pensionable service period. To qualify for the pension, the employer must deposit funds into the member's EPS account for at least one month. The member becomes eligible for the monthly pension from the date of permanent disablement, and the pension will be paid for their lifetime. However, the member must undergo a medical examination to confirm their disability and inability to continue working. This procedure is a precautionary measure to prevent any fraudulent activities by scammers. The member, employer, or family may consult the PF Enforcement Officer for necessary assistance as they guide and provide further support in this matter.
