Respected members,

I worked at an MNC in India for 4 years and then took a permanent international transfer outside India. The Indian-based entity has paid my full and final settlement but did not pay my gratuity. I am still employed by the same organization outside India, but I would like to understand if I can claim my gratuity for my service period in India as I just missed it by a few months... :(

I appreciate any help from experts.

Eligibility for Gratuity on International Transfer

It has to be examined whether the terms of your international transfer of services assured continuity of service or if there was a break in service. If you have completed 4 years and eight months (read 240 days of continuous service in the fifth year of service), you would be eligible to receive gratuity. Please check the factual position and then revert to us.
