PF Applicability for New Employee

A new employee is joining with a salary of 15,500/-. He had PF in his old company previously. Is PF applicable to him now?

The firm is adding ESI for him. I read somewhere that once a member of PF, always a member of PF.

@Vignesh yes PF is applicable, as the employee already have old UAN number

But new employee is not agreeing on deduction of PF. What to do now sir? He himself says ignore PF and give me ESI only. What should the employer do?

Employee Benefits and Form 11 (EPF)

Employers cannot bar any employee from these benefits. The employer must provide Form 11 (EPF) to all employees to fill out. If a previous UAN is present, employees are required to participate in the membership without any ceiling or capping.

The Government of India (GOI) maintains a register of skill development (NCS) where almost every employee's data is stored. This data is used by Shram Suvidha enforcement officers.

Sir, Employer is agreed on PF & ESI. Employee not agreed on PF deduction. How should employer handle?

Addressing Unethical Queries

Once a UAN is allotted to an employee in the past, they cannot escape PF membership/contribution of the establishment covered under the EPF Act.

Regarding EPFO
An employee joins the company with a salary of 30,000/- per month. He doesn't have a UAN. Since his salary is more than 15,000/-, he is exempt from PF applicability. However, he worked only for 7 days and left the job, receiving 7,500/-, which is less than 15,000/-. As his monthly salary is more than 15,000/-, but the payment made is less than 15,000/-, will the PF be applicable for that employee?
