Dear All HR fraternity,

I have a query to seek your response on the following situation: If a contract laborer is absent for the entire month, how many NCP days should be marked in the PF ECR - 26 days or 30 days? For example, considering a month with a total of 30 days and 4 weekly offs, would it be correct to have 26 NCP days (30 - 4)? Or should we show 30 days in the NCP days column?

Hi Venu, PF ECR days should be month days i.e. 30 or 31 depends on number of days of the particular month. Regards, Avinash K.

Dear Venu, The Non Contributing Days in PF shall be 30/31 as per the days in the month. Weekly off is not taken into consideration.

Respected BOPPUDI VENU, I hope you are in a hurry, so here are the answers to your questions:

Understanding NCP Days

You have to show 30 days in the NCP days column. Before writing that, you have to know two facts:

1. What is a Week Off?
Generally, if you worked all working days in a week, you'll get a week off. According to this, they didn't work on weekdays, so no week off. Whoever it may be (contractual/regular), leave rules vary case by case and may change.

2. Difference Between Contract and Regular Employees
With general common sense, the law was different for contract and regular employees. However, in ECR upload, the contractor will upload his/her employees' data, and the principal employer will upload their regular employees' data. Sometimes, the principal employer's HR team may upload the contractor's employees' details on behalf of the contractor. In that case, the HR person has to think that they are working on behalf of others. Actually, the contractor and regular paysheets were different, and the EPFO codes also have to be separate. So, in ECR, there is no difference for contract and regular employees.

If a member is absent for the entire month then the NCP days are 26 days only and not 30 or 31 days. Weekly holiday are not to be added for this purpose.

it will be no of days in a month, if u put 26 then for bal days epf will be payable

If an employee was absent for the entire month for 3 days, what would be the NCP days to mark in PF ECR when the employee received wages only (calculation on 26 days)? Also, what are the NCP days in the case of wages?
