Good Afternoon Everyone,

I have some doubts regarding ESI and EPF applicability in our company.

My company is a Sheet metal Job work company (Sole Proprietor).

1. We have given a salary to the rest room cleaning person on a monthly basis. Do we have to deduct any ESI and EPF?

2. We have paid a salary to some person for dust cleaning work. Is ESI and EPF applicable for this salary?

3. Our company proprietor has some agricultural land. There are 5 persons working on it. Is ESI and EPF applicable to their salaries?

Please let me know if you need any further information.

The first two questions relate to the employment of persons on a salary basis for jobs of an incidental nature. Therefore, if your establishment falls within the purview of the Acts, you are bound to comply with the subscription clauses under them.

I believe that agricultural operations, other than those undertaken in an integrated manner such as plantations and farms owned by any manufacturing industry for its own purposes, are not covered under the Acts.

1. If they are drawing Rs. 6500 per month.
2. Working for more than six months or depending on your company policy.
3. Consider the age factor that covers ESI and PF. If all the above cases are applicable, consider them as working staff and proceed with ESI and PF. Inform them about contribution deductions beforehand.
