Hi, Can you please let me know if an employee is working in a factory and his gross salary is 15,000/-, but he is also doing overtime (OT) and with OT, he is getting 30,000/-. So, do we deduct ESI on his gross salary or on gross + OT salary.

OT is optional, and though ESI deduction is payable on the OT also, the employee is eligible to ESI deduction, when his gross salary without OT or retention allowance exceeds 21000, he will opt out
Hi,
Thank you for the answer. I have some more questions and need clarification. Please help me.
You mentioned that if the basic salary or salary with OT exceeds 21,000/-, the employee needs to be excluded from the ESI. If we exclude employees whose payouts exceed 21,000/- from the ESI benefits and an unfortunate event occurs in the factory, how will the medical expenses or any partial/total loss be compensated for the employees or their family members who are no longer covered by ESI benefits?

Hi,
Please help me with this. If we exclude employees who exceed a payout of ₹21,000 in any company from ESI benefits, and an unfortunate event occurs in the factory involving employees who are not covered by ESI, who would compensate for medical expenses or any partial/total loss to the employee or their family members?
