Can we resign in maternity leave.?? If we utilize maternity leave of 6 months do we need to serve 3 moths atleast to resign?? Is there any sich policy??

Dear Anony, There is no policy as such; Resignation post availing of maternity leaves shall be as per the appointment terms, unless mutually agreed. Regards Rahul

There is no mention of the leave policy in the Act. Leave policies vary from company to company. Please check with your company, as it will be of more concern to them since they are obligated to comply.

It will be the same as the agreed terms; maternity leave/benefits should not in any way affect the employment contract. You ought to give the notice and hand over the charge, which is expected of any responsible employee to enable the employer to do his/her part of settling the full and final payment, relieving letter, etc.
