Hi, I was serving as a permanent employee when I stopped going due to fake reporting by the manager and unnecessary pressure and drama in the company. I reported health issues after HR sent a notice. I replied to the same email asking to be relieved from duties, citing health issues. Now they're saying that they accepted the resignation and require 2 months' notice or basic salary in lieu of it. They've also mentioned project loss. What should be done now when I am really tense about even going there under the pressures they have put and the lies they're telling? Is there a way out from the company without paying back when I don't want a relieving letter or compensation myself?

Why did you wait until you received notice? The moment you had health issues, as a responsible employee, the company should have been contacted and provided with medical certificates, details of likely days of absence, etc.

Questions to Consider

What is your position in the company? How many days were you sick? Are you fit now? Do you have honest documentation of sickness, the line of treatment, and a fitness certificate?

Steps to Take

You have no choice but to go to the company with all medical documentation and seek to rejoin by giving your statement in writing. (Apologize for not informing the company about sickness until HR notice.) Falling sick is beyond control at times, but failure to inform the company is entirely your mistake. Rectify it and rejoin for employment.

Potential Consequences

The company will take action for sudden uninformed absences and may misunderstand medical excuses since you provided this reason only when questioned. Did you think the company would not inquire when an employee suddenly stops coming during a project? You need to review your conduct.

I had initially informed the company of being ill three weeks ago, but due to the mental tension caused by the challenging situation at the office, I did not rejoin or inform them as I was supposed to. Consequently, the notice I replied to was accepted as my resignation.

Many of the issues that occurred there were reported multiple times, including breaches of the same policy they are now using to request the notice. They have since requested a medical certificate, but I do not possess one. I am not interested in rejoining under the current circumstances, especially since they are unwilling to address the issues affecting my health.
