I would like to seek a suggestion regarding an ESIC query. I have not inserted the Insured Person for the last 7 months. Can I insert the person in the back date with the last contribution in September 2016, and no contribution between October 2016 to August 2017? Please suggest any solution to this query.

Clarification on Employee Registration and Contributions

Your question is not clear. You have missed out on registering an employee who joined in September 2016. Now, you want to register him and show his wages for September 2016 as paid, with the rest of the period as non-contributory, and make him active since August 2017, correct?

You can register an employee backdated to September 2016. You can also include his contributions as omitted wages, although this may incur interests and damages. Additionally, you can indicate that the employee was not working or had left from October 2016 to August 2017. However, are his contributions paid from September 2017 till date? No, which means he is still not registered as an existing member. An existing member refers to an employee who is already registered. When you register him retroactively, he will become an IP, and the same ESI number will be used if he is employed again.

It is important to note that for all benefits, including super specialty treatments, the registration date of the employee is considered, not the date of employment. Therefore, an employer's failure to register an employee on time can result in the employee missing out on super specialty treatments or sickness benefits.

Furthermore, these actions will result in interests and penalties.

For better assistance, please draft your query properly and submit it again.

I want to show the last contribution in September 2016 and no contributions for the period from October 2016 to August 2017 as all employees have resigned. At this time, I have recently hired a new employee. Is it possible to add the new employee with a backdated start date?
