Maternity Leave Under the New Law

Under the new law, maternity leave is raised from the current 12 weeks to 26 weeks, as per the Maternity Benefit (Amendment) Act 2016. Maternity leave is awarded with full pay upon completion of at least 80 days in an establishment in the 12 months prior to the expected date of delivery. Maternity leave can be availed up to eight weeks before the expected delivery date.

The maternity benefit is awarded at the rate of the average daily wage for the period of a worker's actual absence from work. A medical bonus of Rs 3500 is also provided. Sections 6 and 7 of the Maternity Benefit Act are relevant. Refer to the National Food Security Act 2013 for some additional benefits. An alternative to the Maternity Benefit Act is the ESIC Act, where entitled females receive maternity benefits.

My concern is that if a female is appointed for a certain area of work and she is pregnant, then when is she eligible to take benefits? How many days does she need to work before she is eligible to take the benefits?
