Understanding Maternity Benefit Eligibility with ESI Contribution Requirements - CiteHR

Hi, I have a query regarding Maternity leave benefits. I joined my current organization in Jan-17, and my ESI contribution started from Jan-17. My baby was delivered in Sep-17. My organization allowed me maternity leave for six months, but ESI-BO refused to pay maternity benefits as I have not worked for 9 continuous months in my current organization. However, I have completed my 84 working days according to the rule.

Please advise.

Hi,

No, your employee is not eligible for maternity leave of 26 weeks from ESIC, and the same should be paid by the employer only. This is because, for claiming maternity benefits from ESIC, the employee has to contribute for at least 2 years.
