Ask them to get legal heir certificates from the authority concerned. If both are legal heirs, then get a declaration in the form of an affidavit from them and file it with EPFO. Inform them to pay 50% of the pension to each.

Please clarify how the Employees' Pension Scheme, 1995 can be allocated to others as you mentioned elaborately for the information of all concerned. You stated, "it can be given to anybody of his/her choice, including charitable and other causes, as informed by the employee." Before replying, please review the question posed by Mr. Hitesh.

Dear Mr. V. Murali,

Please note that EPS cannot be paid to anybody of Members' choice, including charitable institutions. EPS Pension is paid to the Member during his lifetime and thereafter to the spouse, maximum up to 2 children below 25 years of age. If the member is not married, the pension goes to the parents.
