Hi,

We are an IT consulting and staffing company with approximately 50 employees PAN India. We would like to know if the act is applicable to us, and if yes, where and how do we register ourselves. Our employees are located in Mumbai, Pune, Noida, Gurgaon, Chennai, Bangalore, and Hyderabad.

You have to see provision of applicability of the act vis-à-vis manpower of each state. If your manpower in the state exceeds the threshold manpower of the state for applicability, then the state act will be applicable to you.

The applicability of the act depends on the state. An establishment should engage 5 or more persons to be eligible for the Labour Welfare Act (Note - excluding managerial, supervisory, and contractor employees).

Registration Process

For registration, Form A-1 (Challan-Cum-Return in Form A-1) must be submitted to the Labour Welfare Board.

Samuel R Are you sure that the act becomes applicable in all the states of India when they engage 5 or more employees? For your state it may be 5 but for other states it may differ.
