Format of FORM-L

The format of FORM-L is an intimation to the employee that his gratuity has been calculated and is ready for payment. The employee can collect it on the specified date from the office.

Guidelines for Gratuity Payment

Always pay the gratuity by account payee cheque to the employee and obtain his acknowledgment for the file. Get acknowledgment in Form L also from the employee. The copy of Form L can be sent to the Controlling Authority under The Payment of Gratuity Act 1965, and keep the acknowledgment in the records of the establishment.

In case the employee has expired before receiving his or her gratuity for any reason, the same Form L should be served or sent to the nominee as assigned by the deceased employee. Then, check the authenticity and settle the gratuity. If no nomination exists, obtain a copy of the legal heir certificate. If there is more than one legal heir, it is better to deposit the gratuity with the Controlling Authority under The Payment of Gratuity Act 1965, who will hear the management and the legal heirs and allocate the appropriate share to the legal heirs.

Notice for Payment of Gratuity

To: [Name and address of the applicant employee/nominee/legal heir]

You are hereby informed, as required under clause (i) of sub-rule (1) of rule 8 of the Payment of Gratuity (Central) Rules, 1972, that a sum of Rs. [amount] (Rupees [amount in words]) is payable to you as gratuity/as your share of gratuity in terms of the nomination made by [name] on [date] and recorded as a legal heir of [name], an employee of this establishment. (Strike out whichever is not applicable and fill in the amount arrived at.)

Please call at [place] on [date] at [time] to collect your payment in cash/open or crossed cheque. (Mention official working hours of your establishment, giving sufficient time to the employee/nominee to come and collect the amount.)

The amount payable shall be sent to you by Postal Money Order at the address given in your application after deducting the Postal Money Order commission, as desired by you. (My personal suggestion: kindly do not exercise this option.)

Brief Statement of Calculation

1. Total period of service of the employee concerned: [years] years [months] months. (Mention service details)
2. Wages last drawn: [mention wages details]
3. Proportion of the admission gratuity payable in terms of nomination/as a legal heir.
4. Amount payable: [mention the gratuity amount payable]
