Hi,

What if a candidate is made permanent, but the confirmation letter is delayed despite repeated follow-ups? What are the rights of the candidates? How else can the candidate deal with this in a win-win manner? If the candidate is dealt with unfairly, what can he or she do according to the law? Please advise.

Regards,

If a confirmation letter is not issued in a reasonable time, it will be a violation of the contract of employment. Hence, he can avoid the contract and file for damages under the Indian Contract Act. However, a clear chain of evidence like communication and other such items needs to be taken care of.
