Works Committee - what type of works committee? Please elaborate on your query.

For the formation of the committee, please issue a circular and post it on the notice board. Gather nominations, and then elect members accordingly.

Dear Sir,

We have around 250 workers in our company, and there is no union. We need to discuss salary increments and other employment-related conditions with the workers. We are looking to form a committee for this purpose.

Works Committee

In the case of any industrial establishment in which two hundred fifty or more workmen are employed or have been employed on any day in the preceding twelve months, the appropriate Government may, by general or special order, require the employer to constitute, in the prescribed manner, a Works Committee consisting of representatives of employers and workmen engaged in the establishment. However, the number of representatives of workmen on the Committee shall not be less than the number of representatives of the employer. The representatives of the workmen shall be chosen, in the prescribed manner, from among the workmen engaged in the establishment and in consultation with their trade union, if any, registered under the Indian Trade Unions Act, 1926.

It shall be the duty of the Works Committee to promote measures for securing and preserving amity and good relations between the employer and workmen. To that end, they should comment upon matters of their common interest or concern and endeavor to resolve any significant differences of opinion regarding such matters.

The requirement of the works committee is in section 3 (as has been quoted by Mr. Shamra) but the actual procedure is in the rules, so you need to check the rules of the state to which your factory belongs. In Maharashtra, it's in Part IV, starting from Rule 39 onwards. The rules give the complete method of formation, including how the election is to be held where there is no union (or where not all workers are from the union).

Understanding the Works Committee

A Works Committee consists of an equal number of members representing employees and the employer. For example, it can include three members representing workers, who have been chosen or elected by all workers, and another three members who are top-level managers selected by the employer. So, the total is 3 + 3 = 6. They can conduct monthly meetings to discuss general grievances. Workers can discuss their grievances with top-level managers without the intervention of middle-level managers; however, the grievances should be general, not individual. This will help enhance "Employee Relations."

Even though my company is an ITES company and the total employee strength is 200 in my location/branch, I have formed a Works Committee and conduct regular meetings. It is yielding fruitful results.
