Dear Seniors,

Please help me. I just realized that my company name is wrongly registered in EPFO, and now I want to change it. Kindly guide me through the whole procedure of correcting the name of our establishment. I have recently joined this company and discovered this error in the records. Your assistance will be greatly appreciated!

I failed to understand how this kind of mistake can happen. I don't feel anyone can answer you unless you provide correct and complete information.

Questions Regarding Company Registration

What do you mean your company's name is wrongly registered? There are many questions to ask you. Is your company not liable for registration, and did you wrongly submit the application for registration? Under what pretense did you submit it? Is it a mistake only in the name of your company? To what extent?

When did you register your company? When did you submit an application for registration and how? If online, was it with DSC or without DSC? Have you made any remittance of dues so far?

Declaration and Verification Process

When you submit any application for registration, a license, or an NOC, you give a declaration stating that the information or details furnished by you are true and correct to the best of your knowledge. Why do you need to submit such a declaration? Does such a declaration have no value?

After the introduction of DSC for applying for registration, there is no physical verification by the department of your documents or inspection of your place of operation or business. You may be liable for action for furnishing wrong and incorrect information or details.

Recommended Action

You need to approach the Regional Office of the Provident Fund Organization immediately, admit your mistake, and request the cancellation of registration if it is indeed a mistake.

During the online registration process, the name of the company is matched with its PAN, and mismatched inputs are rejected by the OLRE site itself.

Your registration seems to be an old one, and you cannot change or rectify it on your own. You have to approach your Regional Office with a written request and documentary evidence for correction.

I just joined the company last month, and they are already registered under PF and ESIC through their consultant. He is the one to be blamed for it, and it surprises me that the company owner or our last HR manager didn't discover this mistake since 2011 when they got registered under EPFO.

Issue with Company Name Registration

The mistake was about the wrong spelling in the name of the company; in EPFO records, it is registered as ONE SORUCE INDIA PVT. LTD, but the correct one is ONE SOURCE INDIA PVT. LTD. It's the first time I'm dealing with such a problem, so kindly show me the right way to correct it.

Dear Gaurav ji,

There is an error in the spelling of your company name, and for all these years, you have been complying under this incorrect name. You need to write a letter to the RPFC explaining that there was a spelling mistake in your company name during the registration process and requesting them to rectify it. It is essential to provide valid documentary proof of your company name. The correction will be made by the CPFC through their IT department in New Delhi.

Procedure to Change Establishment Name in Form-5A

Please change the name of the establishment in Form-5A and submit it to EPFO. Please log in with your user ID and password at:

-> http://esewa.epfoservices.in
-> ECR MENU
-> FORM 5A (OWNER DETAILS)

Fill in the establishment name you wish (if a PVT LTD firm, the name should match with PAN; if a partnership/proprietorship firm, the name should match with any government license you apply for). Fill in other details if blank (owner details, bank details, etc.). Submit, take a print, and sign carefully. Submit to the nearest EPFO with a request to change the name of the establishment on your letterhead.

You are very confidently providing solutions to the queries. Have you ever done this before? Have you edited the name of any entity in Form 5A so far? You cannot edit the name of the company in Form 5A. Correction in the name of any entity or change of name of an entity is not an easy task. You cannot edit the name of any company simply by submitting a fresh Form 5A. Even when the department was not IT-enabled, it was a very difficult task to get the name edited by the authority. Even in the case of a change of name of any Private Limited or Limited Company, consequent upon completing due formalities with ROC, you need to write to RPFC.

Dear Korgaonkar K.A., please refer to my last sentence: "with a request to change the name of the establishment on your letterhead." I understand that the name of the establishment in Form 5A does not automatically mean a name change in your monthly challan/ECR/Form 23/member passbook/14-B, 7A, 7Q notice, or any other document produced by EPFO. However, it is the first step to change the name in EPFO records. Along with the request letter for a name change, you have to enclose Form-5A, Memorandum of Articles, PAN, and any other government licenses you hold.

I would like to add some points as suggested by dhavalking77:

1. Submit a request letter only to the respective EPFO office.
2. MOU needs to be enclosed along with your request letter.
3. Register of certificate under the Companies Act needs to be enclosed.
4. ID & Address (Current EB bill, Telephone bill & Bank Statement) Proofs need to be enclosed.
5. Copy of the name change request letter (if you have submitted in the past) for reference only.
