Since the total length of service rendered in the establishment on the date of retrenchment falls well below the minimum qualifying period of service of 5 years, the retrenched employee is not statutorily eligible for gratuity.

As regards incentives, if the incentive is production-linked or performance-based, well, the retrenched employee is entitled to such incentives.
