I am Kamleshwar from Delhi. I had worked for 8 years and 8 months in a Delhi-based private limited software company. After leaving, I came to know about gratuity. For the last two months, the company has not responded to my emails regarding gratuity. On the phone, HR is not providing a clear response, she just says they are looking into the matter. Please suggest what I should do next.

When did you resign from the company? Always have the reminders sent via email or a hard copy sent via registered post, without clearly mentioning the sender's details. You can approach the Labor office or file a claim before the Controlling Authority under the Payment of Gratuity Act within the area where your employer's establishment is situated. Once you send a legal notice, they will automatically pay you, as through court they have to pay you with interest of 10% and possibly with or without a fine.

Dear Mahesh, I resigned in May with a 3-month notice period, and my last working day was on 30th Sep. On the 6th, I received the full and final settlement letter, which I accepted. However, I later discovered that there was no mention of gratuity in the settlement. I immediately emailed Form I to our HR Manager on the same day, but I have not received any response from her. Despite sending a reminder email, there has been no reply. When I called her, she avoided discussing the issue of gratuity and mentioned that an update would be provided after further discussion.
Today, I visited the labor office and submitted an application. The Assistant Labor Officer informed me that the process might take some time. I am wondering if there are any other avenues or channels through which I can address this issue or make a complaint?
