My name is Rajeev. My last basic salary was 15k, and I worked from July 2008 to May 2015. Sir, can you please calculate my gratuity amount? My company is telling me it is 45K, but they also deducted 15k because I gave only one day's notice. Is this the right amount? Should I accept it or should I go to court?

Hi,

Following is the Gratuity calculation in your case:

Calculation: W x Y x 15/26 where W = Last Wage drawn i.e., basic + DA Y = number of completed years of continuous service (six months or less to be ignored and more than six months to be counted as full year). 15 = 15 days salary 26 = No. of working days in a month.

15000*7*15/26 = 105000*15/26 = 1575000/26 = 60576.92

The total amount of gratuity you should receive based on the details provided is Rs. 60,576/-, and the company doesn't have the right to deduct the notice pay from gratuity. Please have a word with your HR department first and then proceed to the next level.
