my company is not paying salary..for the last two months..and its not providing any ESI,or Pf facility to employees its a news channle

Hi,

As per the Payment of Wages Act, the company is required to pay employees' salaries by the 7th of the following month. If there is any delay in payment, the company is liable to pay interest as per the legal requirements.

If an employee's salary has been pending for the last 2 months, it is advisable to contact the Labor Inspector under the Payment of Wages Act. (If the salary is Rs. 18,000/- per month)

All laws are being violated by this news channel, including non-payment of PF, ESIC, and salaries. If you are in a group, you can consider approaching higher management. Is the salary not being paid to all employees or just a few? Employees within the same company can determine whether the financial problems are genuine or if management is being unscrupulous. The PF commissioner and ESIC can be contacted with complaints about not subscribing to these mandatory schemes. It is advisable to take joint action in this matter.

thanks for your reply..the chairman threatend the employees that he will terminate them if any body goes to labour inspector do you suggest any route for this

Omelette can be made without breaking an egg. Accept the risk in going to official agencies or accept late payments and have less savings/protection like PF/ESIC. It is difficult, but then this is a fact of life.

Regarding your line "the chairman threatened the employees that he will terminate them if anybody goes to the labor inspector," that is bound to happen if one or a few employees go. The only way to handle this is for all the affected employees to go to the labor inspector. If not, the ones who went will surely be targeted by the management. As Nathrao mentioned, "Omelette cannot be made without breaking an egg" (he meant this rather than 'can,' I presume). Let it be a collective action rather than individual or by a few. Also, suggest looking for other jobs in the meantime ASAP.

Firstly, are all of you not receiving a salary or wages, or is it just some of your friends along with you who are not getting paid? If some of the employees are receiving a salary, they may ignore you and others who are not. In that case, it is essential to have an attendance sheet where daily presence is marked by someone. Get a copy of it or take a photo with your mobile. This is very important.

Employment Documentation

Secondly, have all of you received a letter of employment, or are you working based on word of mouth?

Payment Methods

Thirdly, do all of you have a bank account for salary credits, or are you all being paid in cash?

Terms and Conditions

Fourthly, have you received your terms and conditions or work contract clearly furnished?

In the absence of any of the above, it means you are all being engaged for exploitation. It is better to approach the labor officer and submit your complaint in writing for appropriate action.

Can dispute be raised in civil court besides in labour court for a WORKMAN on Non payment of salary as labour court processes are too slow.
