Hello All,

I left my job 2 years ago, and at the time of resignation, the full and final settlement was done by the company. Now, when I requested them to withdraw my accumulation in the EPF account, they are denying the request. According to them, an amount of Rs. 50,000 is to be paid by me.

I want to know if the company has the right to retain my EPF balance amount and what options I have if the employer is not signing Form 19.

Send the Form 19 filled out by registered post to the employer for submission to the EPF authorities. If the employer fails to do so within 5 days, file a complaint with the EPF authorities for the employer's failure to fulfill statutory duties under the EPF Act. Request the EPF authorities to grant permission to prosecute the employer. Ask the authorities to initiate the payment processing in such circumstances.

In addition to Sushil, it is strange why the demand of ₹50,000 was raised. For this misconduct, you must approach the RPFC with a written complaint enclosed withdrawal forms. They will definitely do the needful.

Send your form to the regional commissioner along with your P form and an explanation that you approached the company, but they are not authorizing your form and are asking for Rs 50,000/-. An enforcement officer will visit your ex-employer along with your form.
