We had promotions for the product; hence, we were asked to work on Sunday, 25th & 26th January. We were told we could take a day off later. However, they never gave us a day off. Now again, they have asked us to work on Sunday, 15th. I am sure they won't pay us double or give us a day off later. Is this fair for a sales executive who works 9-9 in the market not to get a Sunday as a holiday? Please help.

No, it's not good or legal if they are neither paying you extra nor giving you compensatory time off. Talk to HR. Keep all details of the conversation in records so that you can use it for justice. Good luck.

Well, life is not fair. So, what actually is your question? If you want to grow within your organization, you have to show your willingness to work harder and meet the requirements. If you don't, you will find that others in your team are getting higher rewards and promotions.

Compensatory Day Off and Double-Rate Wages

As per the law, anyone working on a weekly off or a holiday is entitled to a compensatory day off. You should ask your manager or your HR for the compensatory day off that was promised to you.

Yes, you are entitled to double-rate wages for working on a Sunday if you are not management staff. Whether you want to raise it with them or not is a call you have to make today.

Compliance with the Factories Act

No employee should work continuously for more than 10 days as per the Factories Act. (I don't know about shops and establishments, but it will likely say the same.) So, if you work on Sunday or any other holiday, you will have to avail of that day off within the next 3 days.

Weekly Off Requirements

For every 48 hours of work (8 hours x 6 days), you should have one weekly off. If your company is not following this and is making you work, you can raise an Industrial Dispute with the Labour officer. They will take care of it.

Wow, Abhay, from which school did you complete your PG or graduation? You seem to have a bossy attitude, stating that sales personnel are not human and should work without leave. The law clearly states that if a person works on a week off, then either they should get compensatory time off, swap the leave with another working day as per the roster, or they should be paid extra.

On special occasions like the launch of a new product, staff/employees may have to work extra. This is part of working life. Accept it with grace and try for a compensatory day off on some other day. Legally, things may be different, but enforcing it is a different story. Some compromise in life is part of our working life. I agree it is unfair to expect a person to work continuously without breaks, but we need to find a middle ground.
