ESIC Facility for Contract Workers

I work in an SSI as an HR executive. We do not have an ESIC facility for contract workers. Recently, a worker joined our company on a contract basis, and he had an ESIC facility at his previous organization. He has paid contributions for seven years in the previous company. Now, in our company, he has not been paying contributions for the last three months.

My query is, can he avail ESIC leaves, and can we let him avail those? If the contribution is not paid, what will happen to the employee's account?

You have not indicated in the remarks whether the unit in which you are working is covered under the ESI Act. If so, why do you "not have ESIC facility for contract workers"?

If your unit is not directly covered under the ESI Act, is the contractor your unit engaged with having a separate ESI Code Number based on the number of workers engaged by him as a "shop"?

If your unit is not covered under the ESI Act, then how many persons are engaged in a month, and also, how many persons are engaged through a contractor on a contract basis?

ESIC Provisions for Contract Workers

ESIC provisions do not distinguish between regular and contract workers. Compliance can be made using your company's ESI Code. The insurance number will remain the same. If the contributions are not deposited, the worker will be deprived of ESIC benefits in the future, and your company will be considered a defaulter.
