Dear R. Shetty & Pon, Some states have laws regarding minimum HRA, while not all states do. I am aware of three states with such laws: Maharashtra, Gujarat, and West Bengal. One can correct my second statement, but not the first one above.

As far as my knowledge goes, each establishment has its own rules and regulations regarding HR allowance. Perhaps state rules are applicable only to state government employees, in whichever state they are located.

Regarding industrial establishments, there must be laws regulating HRA or housing facilities to be provided by the employer and provisions in the event of not providing residential accommodation.

As per I.T.rules, HRA as prescribed is exempted from income tax. If there is no component of HRA in payslip, one can not claim exemption of Income Tax. Pon

I may be wrong in giving an answer to the querist. Indeed, the query is wrongly put, according to me. The querist, I feel, wanted to ask whether the house rent allowance is MANDATORY only in Maharashtra or in other states also. Therefore, my answer was that some of the states have a law for a minimum HRA. This means, in those states, it is mandatory to pay a minimum HRA to the employees. In the rest of the states, it is not binding on you to pay HRA.
I disagree with the statement made by our Senior member, Shri. Pon: "It is applicable throughout India." Though it is not binding on you to pay HRA, you can pay it. If you pay it, the employee can avail IT exemption on this payment under certain circumstances as per section 10 of the IT Act.

House rent allowance comes under the definition of "Wages" according to the Minimum Wages Act. Therefore, considering the universal applicability of the Minimum Wages Act, it is compulsory to pay. In Maharashtra, there is a special provision for paying HRA under the Maharashtra HRA Act.

Mr. Keshav Korgaonkar has rightly said that it is mandatory to pay HRA to employees in states like Maharashtra, where there is a statute on minimum HRA payable in vogue. I concur with him that not all states may have enacted acts similar to the one in Maharashtra; it is a state act. Other members can contribute information on this.
As far as the definition of 'Wages' under the Minimum Wages Act is concerned, it includes HRA, as Mr. Hemant Kondhalkar mentioned.

I do not agree with you that the HRA is compulsory to pay since it is included in the definition of wages under the MW Act. What does the definition mean if you pay HRA, then it is wages.

Minimum wages notified by each state have two components: basic and DA. In some states, instead of DA, they notify a special allowance. Nowhere in the minimum wages notification is HRA notified or made mandatory. As Mr. KK said, Maharashtra and Gujarat have separate legislation where a minimum HRA component of 5% of basic + DA is required to be given. I was not aware that West Bengal has the same rules. However, in no other state is HRA a part of minimum wages or mandatory under the labor laws.

HRA or house rent allowance is applicable in all states of India but what differ is the % as in metros it is 50% of the basic and in other cities it goes to 40% of the basic.
